Complicated Environmental Regulations regarding storage, packaging, labeling, transportation and disposal of various wastes can be frustrating and time consuming. The EPA's Resource Conservation and Recovery Act (RCRA) specifies technical standards which are to be used to identify hazardous wastes. Once a waste has been characterized as ‘hazardous’, the generator is required to meet all handling and disposal regulations stipulated in Title 40 Code of Federal Regulations (CFR) part 262 (Standards applicable to generators of hazardous waste). For many businesses, trying to remain in compliance with federal, state, and local laws regulating waste management often can be overwhelming. Failure to abide by these regulations can result in costly fines, regulatory enforcement, or permit revocation. EPA's Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) instilled the concept that a hazardous waste generator has ‘cradle to grave’ responsibility of their wastes. Essentially, a generator is still responsible for their hazardous waste even after it has been transferred to a federally licensed Treatment, Storage and Disposal facility (TSDF).
